On July 22, 2019, the Court issued its Order on Plaintiffs’ Motion for Conditional Certification. The Court tabled its decision on whether to grant Plaintiffs’ Motion for Conditional Certification until after the Parties further brief certain matters related to Plaintiffs’ Motion.

On June 17, 2019, we filed Plaintiffs’ Supplemental Brief pursuant the Court’s Order to brief issues related to Plaintiffs’ Motion for Conditional Certification. (See Updates 7, 13, and 19).

On June 10, 2019, the Court issued its Order Granting in Part and Denying in Part Defendant’s Motion to Strike. Importantly, the Court denied FCA’s efforts to strike allegations in our Complaint.

On April 22, 2019, we filed our Reply to Defendant’s Response to Plaintiff’s Motion for Conditional Certification, Judicial Notice, and Motion to Compel. This relates to Updates 7 and 13. We, the Plaintiffs, are seeking a Court Order certifying the class as defined in our Complaint.

On April 4, 2019, the United States Court of Appeals for the Sixth Circuit DENIED Defendant FCA’s Petition for Rehearing and/or Rehearing En Banc. This means that Plaintiffs may proceed with their case and seek Class Certification.

On February 22, 2019, Defendant FCA filed their Petition for Rehearing and/or Rehearing En Banc to the United States’ Sixth Circuit Court of Appeals in an effort to have their prior decision reversed. See Update 16.

On February 8, 2019, the United States’ Sixth Circuit Court of Appeals denied Defendant’s petition for permission to appeal the District Court’s ruling that subgroups are legally viable in disparate impact collective action cases, allowing Plaintiffs to move forward with their action.

On September 4, 2018, the Court filed its Order Granting Motion to Certify Issue for Interlocutory Appeal and to Stay Proceedings.  This essentially means that the case will be put on hold while the United States' Sixth Circuit Court of Appeals addressed issues raised in this case.

On August 24, 2018, we filed Plaintiffs' Response to Defendant's Motion to Certify the Court's August 6, 2018 Order Regarding the Validity of Subclasses in ADEA DIsparate Impact Collective Actions for Immediate Appeal and Stay Proceedings Pending Appeal.  (See Update 11).

Also on August 20, 2018, Defendant filed its Response to Plaintiffs' Motion for Conditional Certification, Judicial Notice, and Motion to Compel.  (See Update 7).

On August 20, 2018, Defendant filed its Answer and Affirmative and/or Other Defenses to Plaintiffs' Second Amended Collective/Class Action Complaint.  (See Update 5).

On the heels of the denial of Defendant's motion to dismiss, on August 10, 2018, Defendant filed its Motion to Certify the Court's August 6, 2018, Order Regarding Validity of Subclasses in ADEA Disparate Impact Collective Actions for Immediate Appeal and to Stay Proceedings Pending Appeal.

On February 23, 2018, we filed a Motion for Conditional Certification, Judicial Notice, and Motion to Compel, asking the Court to Certify our defined Class.

As anticipated, on February 21, 2018, Defendant FCA filed their Motion to Dismiss Plaintiffs' Second Amended Class/Collective Action Complaint and/or Motion to Strike Class and Collective Action Allegations in the Second Amended Complaint.
